Welcome to Mercury Distribution Ltd customers, your use of the site and any order placed with us constitutes your agreement to the following terms and conditions:

The following user agreement (‘Agreement’) governs the use of the Mercury web sites and all services provided by the company. Please read carefully the terms contained in this agreement.

You can access this agreement at various points throughout the site and if you do not agree with any part of these rules, please do not continue to use the Site. Mercury Distribution Ltd expressly reserves the right to revise the rules contained in this agreement.

These terms and conditions do not affect your statutory rights. To order goods through this website you must be at least 18 years of age and accept delivery within our served areas. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.

 

Pricing

Unless otherwise specified by the Seller in writing, all prices quoted are nett, and are exclusive of GST. All prices quoted are, unless stated in writing, subject to variation without obligation to give prior notice.

 

Minimum Order Value

The company operates a minimum order value policy to create efficiency and environmental benefits for both the customer and supplier. Minimum on-line orders are £30, and Credit Account holders £20.

 

Description of Goods

Most product descriptions are provided by the manufacturer. Product specifications, images and other information published on the website have either been acquired from suppliers, manufacturer’s, publications, publicists, or been gathered from public-domain sources. The Company accepts no responsibility for such descriptions.

 

Copyrighted Material

Mercury Distribution Ltd permits you to view and use the material and data on the site solely for your personal, and non-commercial use. It is forbidden for users to sell or modify the material in any way for any public or commercial purpose.

 

Suitability

Any recommendation or suggestion relating to the use of the goods made by our Representatives or given in our literature is given in good faith but it is for the buyers to satisfy themselves as to the suitability of the goods for their own particular purpose.

 

Availability of Goods

All products and services are subject to availability and may be withdrawn at any time. Information on the site detailing stock levels should not be viewed as a guarantee of availability.

 

Notification of loss, damage, shortages, or incorrect goods

Any transit damage to the goods, shortages or incorrect goods supplied must be reported to the Seller within 24 hours from receipt of order.

 

Returns

Goods delivered in accordance with an order cannot be returned without the consent of the supplier. Application for consent will only be considered within 5 days of delivery and must be made in writing.

 

Risk

Following delivery of goods to the door, or to a nominated person, responsibility for the goods lies with the purchaser. From the time of receipted delivery of the goods, any loss or damage to the goods will be at the purchaser’s own risk.

 

Alcohol

Alcohol is only offered for sale to clients aged 18 years old or over. By placing an order, the customer affirms that he/she is at least 18 years old. If the alcohol is purchased as a gift, then the recipient must be aged 18 years old or over.

All alcoholic goods must be signed for on delivery by an adult aged 18 years or over with valid proof of identification. If proof is not obtained the goods will not be delivered.

 

Title to Goods

The property in the goods shall remain vested in the Seller and shall not pass to the Buyer until the Buyer has made payment in full of the purchase price. So long as the property in the goods remains vested in the Seller, the Seller shall be at liberty at any time to retake possession thereof.

 

Credit Accounts & Payment Terms

Use of credit account facilities with the Seller is deemed to be a contractual acceptance of these Terms and Conditions of Sale in general, and the Terms of Payment in particular. Customers to whom credit facilities have been granted must settle accounts within 28 days from the end of the previous month hereinafter called the ‘due date’. In the event of any account remaining unpaid after its due date for payment, then payment for all goods delivered at any time by the Seller (including goods delivered after those to which the unpaid account relates) shall forthwith become due. In the event of goods not being paid for within the due date the seller reserves the right to charge the Buyer interest at 3% above Bank of England Base Rate per month on the outstanding balance from the due date until payment is made in full, the seller also reserves the right to suspend deliveries and stop the account, until the balance is paid in full. The Buyer will pay at the due date to the Seller all GST charged in respect of any sale hereunder.

 

Default

The Company shall be entitled to cancel or suspend all outstanding orders and contracts if the customer shall have failed to make any payment due to the Company in respect of any order or contract or shall have a receiver appointed, go into liquidation or bankruptcy, or cease to trade.

 

General

These conditions of sale shall apply to every agreement entered into by the Company for the sale of goods and shall accordingly override any conditions attached to or printed on or referred to in any order form or other document emanating from the purchaser and delivered to the Company prior to at the time of or after the conclusion of a bargain for the sale and purchase of any goods by the Company to the Customer.

 

Errors and Omissions

Typographical or clerical errors or omissions in any document are subject to revision without penalty or prejudice.

 

Proper Law

These Terms and Conditions and all Contracts to which they apply shall in all respects be governed by and construed in accordance with the law of Jersey or Guernsey and shall be subject to the exclusive jurisdiction of the Islands Courts.
